Terms of Service

1. Agreement

These Terms are an agreement between you and Shelby Dynamics LLC, a Missouri limited liability company ("Terrain Ready", "we", "us"). They govern your use of the Terrain Ready mobile app and the terrainready.com website (the "Services"). By creating an account or using the Services, you agree to them. If you don't agree, don't use the Services. Our Privacy Policy explains how we handle your information.

2. Health and Safety

Terrain Ready is not medical advice. Training plans, workouts, exercise guides, readiness scores and coaching notes are general fitness information. Consult a physician before starting or changing an exercise program, especially if you have a medical condition, injury, are pregnant, or are unsure whether you are ready.

Exercise, rucking, hiking and hunting carry a risk of injury and, in the backcountry, serious harm. You choose whether and how to perform any exercise, you are responsible for judging your own limits and conditions, and you should stop if you feel pain, dizziness or shortness of breath. To the extent the law allows, you take on these risks.

The Services do not replace navigation, weather, avalanche, first-aid or hunting-regulation resources. Follow all local hunting laws and regulations.

3. AI-Generated Content

Plans and other content are written by AI models from the information you provide. AI can be wrong or unsuitable for you. Review every workout with common sense, keep the information you give us accurate, and skip or change anything that doesn't suit your health, ability or equipment.

4. Your Account

You must be at least 13 years old (or older where local law requires) to use the Services. Give accurate information, keep your sign-in secure, and tell us if you think your account has been misused. You are responsible for activity on your account. You may delete your account at any time in Settings.

5. Free Plan and Terrain Ready Pro

The free plan includes week 1 of your plan, the phase outline and one open hunt at a time, and shows ads. Terrain Ready Pro is an optional subscription that unlocks the full program, a plan for every hunt, analytics and Health sync, without ads. Features may change over time.

Subscriptions, renewal and cancellation

• Terrain Ready Pro is offered monthly ($9.99 USD) and annually ($79.99 USD), or at the local price shown in your app store before you buy.
• Payment is charged to your Apple ID or Google Play account when you confirm the purchase, or when a free trial ends.
• Subscriptions renew automatically at the same length and the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel in your App Store or Google Play account settings. Cancelling stops the next renewal; you keep Pro until the end of the period you paid for. Deleting the app or your account does not cancel a subscription.
• If a free trial is offered, any unused part of it ends when you buy a subscription. If you don't cancel before the trial ends, the subscription starts and you are charged.
• Refunds are handled by Apple or Google under their policies.
• If we change the price, your app store will tell you in advance and, where required, ask for your consent before you are charged the new price.

6. Acceptable Use

Don't misuse the Services: no reverse engineering, scraping, interfering with or overloading our systems, getting around usage limits or paid features, using the Services to break the law, or accessing another person's account.

7. Your Content and Ours

You own the information you enter. You give us permission to store and process it to provide the Services, as described in the Privacy Policy. Everything else in the Services, including the app, website, design, text and generated plans as a product, belongs to Shelby Dynamics LLC or its licensors. We grant you a personal, non-transferable licence to use the app for your own training.

8. Apple App Store

If you downloaded the app from the Apple App Store, these Terms are between you and Terrain Ready, not Apple. Apple has no obligation to provide maintenance or support, is not responsible for the app or any claims relating to it, and is a third-party beneficiary of these Terms with the right to enforce them against you. Apple's Licensed Application End User License Agreement also applies, except where these Terms say otherwise.

9. Disclaimers and Limitation of Liability

The Services are provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, to the extent the law allows. We don't promise any particular fitness result or hunting outcome.

To the extent the law allows, Terrain Ready is not liable for indirect, incidental, special or consequential damages, or for injury arising from exercises you choose to perform, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.

10. Ending Use

You can stop using the Services and delete your account at any time. We may suspend or close accounts that break these Terms. Sections that by their nature should survive (such as disclaimers and limitation of liability) continue after your account ends.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Missouri, and you and we consent to their jurisdiction. Nothing here limits consumer rights that the law of your country of residence gives you and that cannot be waived.

12. Changes

We may update these Terms. We will post changes here and update the date above, and for significant changes we will tell you in the app. Continuing to use the Services after changes take effect means you accept them.
